Исследование посвящено историко-правовому анализу установления нормативных предписаний, устанавливающих уголовную ответственность за создание преступного сообщества, в советский период. В ходе исследования проанализирован весь этап развития советского периода соответствующих норм, начиная с дореволюционного законодательства, Руководящих начал 1919 г., уголовных кодексов РСФСР 1922, 1927 и 1960 гг., и вплоть до распада СССР. Выявлены тенденции развития советских норм об организованной преступной деятельности. Сделан вывод, что борьба с данным явлением является необходимой, поскольку на всем протяжении советского периода законодатель предусматривал соответствующие статьи борьбы с данными преступлениями. Отстаивается позиция того, что данные нормы являются социально обусловленными и необходимыми.

The study is devoted to the historical and legal analysis of the establishment of normative provisions establishing criminal liability for the creation of a criminal community during the Soviet period. The study analyzes the entire stage of the Soviet period development of the relevant norms, starting from pre-revolutionary legislation, the Guiding Principles of 1919, the Criminal Codes of the RSFSR of 1922, 1927 and 1960, up to the collapse of the USSR. The trends in the development of Soviet norms on organized criminal activity have been identified. It is concluded that the fight against this phenomenon is necessary, since throughout the Soviet period the legislator provided for relevant articles to combat these crimes. The position is defended that these norms are socially conditioned and necessary.
