Статья посвящена исследованию принципов организации и деятельности Банка России. На основе анализа законодательных норм автором были сформулированы принципы организации и деятельности Банка России. Указанные принципы определяются как легально выраженные основополагающие начала, идеи, определяющие сущность организа ции и деятельности Банка России. Система принципов организации и деятельности Банка России состоит из основных и специальных принципов. Основные принципы отражены в Конституции Российской Федерации (принципы независимости Банка России, подотчетности Банка России, невмешательства в деятельность Банка России органов государственной властисубъектов и органов местного самоуправления Российской Федерации). В свою очередь, специальные принципы содержатся в федеральных законах (в томчисле в кодексах) (принци пысоблюдения банковской тайны Банком России, обязательности нормативных актов Банка России, некоммерческой направленности деятельности Банка России, согласования деятельности Банка России с государственными органами и должностными лицами, единства системы Банка России, централизованного построения системы Банка России, вертикальной структуры управления системой Банка России, сочетания единоначалия и коллегиальности в управлении Банка России, разделения полномочий по соответствующим уровням системы Банка России, организации Банка России на основе федеральной собственности). Ввиду того, что в федеральных законах отражены основные принципы, в последнем случае подра зумеваются тепринципы, которые не были установлены в Конституции. Автор резюмирует, что проблема принципов организации и деятельности Банка России остается недостаточно изученной и требует дальнейших исследований.

The article is devoted to the study of the principles of the organization and activ ity of the Bank of Russia. Based on the analysis of legislative norms, the author formulated the prin ciples of the organization and activity of the Bank of Russia. These principles are defined aslegally expressed fundamental principles, ideas that define the essence of the organization and activity of the Bank of Russia. The system of principles of the organization and activity of the Bank of Russia consists of basic and special principles. The basic principles are the principles reflected in the Constitution of the Russian Federation (principles of independence of the Bank of Russia, accountability of the Bank of Russia, non-interference in the activity of the Bank of Russia by state authorities of subjects and local governments of the Russian Federation). In turn, special principles are contained in federal laws (including codes) (principles of bank secrecy by the Bank of Russia, mandatory regulations of the Bank of Russia, non-commercial orientation of the Bank of Russia, coordination of the Bank of Russia with government agencies and officials, unity of the Bank of Russia system, central ized construction of the Bank of Russia system, vertical management structures of the Bank of Russiasystem, a combination of unity of command and collegiality in the management of the Bank of Russia, division of powers according to the appropriate levels of the Bank of Russia system, the - - № 4 2024 68 organization of the Bank of Russia on the basis of federal ownership). Due to the fact that the basic principles are reflected in federal laws, in the latter case, those principles that were notestablished in the Constitution are implied. The author summarizes that the problem of the principles of the or ganization and activity of the Bank of Russia remains insufficiently studied and requires further research.
