Статья содержит сравнительно-правовой анализ прямых договоров ресурсоснабжения в сфере жилищно-коммунального хозяйства. Исследуются предпосылки реформы, правовая природа института, субъектный состав, порядок заключения и исполнения, результаты правоприменения 2019–2025 гг. Выявлены ключевые проблемы: разграничение ответственности за качество ресурса и внутридомовые сети, перерасчёты при нарушениях, слабая защита потребителей в условиях монополии. Проведено сравнение с зарубежными моделями, выделены различия в конкуренции, прозрачности тарифов и защите прав. Сформулированы предложения по усилению гарантий потребителей с учётом зарубежного опыта.

The article provides a comparative legal analysis of direct resource supply contracts in the housing and communal services sector. Itexamines the prerequisites for the reform, the legal nature of the institution, the composition of parties, the procedure for conclusion and performance, and the results of lawenforcement practice in 2019–2025. Keyproblems identified include: the unclear delineation of liability for resource quality and the condition of in-house networks, difficulties with charge recalculation in cases of violations, and inadequate consumer protection under monopoly conditions of suppliers. A comparison is made with foreign models, highlighting differences in supplier competition, tariff transparency, and consumer rights protection. Proposals are formulated to strengthen consumer guarantees, considering elements of foreign experience.
